The panel will briefly look at the development of law, ''The Eastern City'', and consider the questions of absolute versus qualified warranties, using various references. Time permitting, the panel will also address questions such as - safe port at the time of the nomination with nothing to suggest that it may become unsafe and then becoming so while the vessel is in the port; unsafe at the time of nomination but safe when vessel arrives and is at the port; consequences of owner's decision to accept the orders to sail to an unsafe port and the issues of forfeiting the right to damages, mitigation and indemnity. Panel will then move on to the practical considerations to avoid disputes by bringing in clarity.
